Privacy Policy

1. In short

• We collect information you give us, information generated as you use forms, and technical or usage information generated when you use the website.
• Public pages load Google Analytics 4, Meta Pixel and Vercel Analytics on the initial page visit. We do not currently operate a cookie consent manager or preference centre.
• Some multi-step forms transmit completed steps before you finish. A qualifying phone number in the contact form can cause a partial lead to be saved and our team notified after roughly 120 seconds, even if you do not complete the form.
• We use information to respond, operate the website, administer requested services and business relationships, and measure website and campaign performance.
• You can contact us about access, correction, a privacy complaint or a request that we consider deletion.

2. Information we collect

Information you provide

Depending on the form or interaction, we may collect your name, phone number, email address, company, website or Google Business Profile URL, market or category, competitors, business type, city or service area, location count, current challenge, prior attempts, timeline and goal.

Contact, audit and med-spa forms may also create a lead identifier and collect submission and update timestamps, the page or landing URL, referrer, browser or user-agent details, UTM campaign values, gclid, fbclid and first-touch attribution.

Strategy lead forms collect your name, email address, optional company, and the source or slug of the strategy requested. Subscription forms may collect your email address and source. Scheduling can collect booking contact details, company, meeting times and meeting information through Cal.com.

Where a private proposal acceptance process is made available, it may collect the accepting person’s name, email, phone, business, ABN, selected plan, discount information and notes. Access to private material may also require authentication information.

Technical and usage information

Google Analytics 4, Meta and Vercel may collect technical and usage identifiers in accordance with their systems, such as cookie or device identifiers, IP-address-derived information, browser and device information, referring pages, pages viewed, interactions and timestamps. Searchmaxxed configures GA4 page paths to remove query strings and fragments before page-view transmission.

Sensitive and unsolicited information

Our ordinary website forms are not intended for sensitive, confidential, regulated or highly personal information. Do not send that information unless we specifically request it and provide an appropriate method. If we receive personal information we did not request, we will consider whether it may lawfully be retained and take reasonable action where it is not required.

3. How and when collection occurs

We collect information directly when you enter it in a form, email us, request a strategy, subscribe for a resource, arrange a meeting, access a private proposal or otherwise communicate with us. We also collect information automatically when the website and its measurement technologies operate.

If you do not want form information collected in this way, do not start or continue the relevant form. You can instead email b@searchmaxxed.com with only the information you choose to provide.

4. Why we use and disclose information

We may collect, hold, use and disclose personal information to:

• respond to enquiries, assess fit, provide requested material and arrange meetings;
• prepare, deliver, administer and support proposals, services and client relationships;
• operate, maintain, secure, troubleshoot and improve the website and our systems;
• measure website usage, form activity, campaign attribution and the performance of content or advertising;
• validate, deduplicate and route submissions;
• match or create CRM people, companies and deals, add relevant notes, and create follow-up tasks;
• send requested materials, subscription or marketing messages where applicable, confirmations, booking information, service communications and internal notifications;
• maintain business records, manage risk, protect rights and comply with legal or regulatory obligations; and
• use information for another purpose with your consent or where otherwise permitted or required by law.

We may also disclose information to staff, contractors, professional advisers, regulators, courts, law-enforcement bodies or another party where reasonably necessary, authorised or required by law, or in connection with a genuine business restructure or sale subject to appropriate safeguards.

5. Providers and recipients

The following providers are evidenced in our current website and business-data flows. Refer to their current privacy information for details of their services and handling.

These providers may act as processors, service providers or independent controllers depending on the service and context. Their own terms and privacy notices govern their handling of information within their systems.

6. Analytics, cookies and browser storage

Public routes immediately load Google Analytics 4, Meta Pixel and Vercel Analytics. Observed cookies include _ga and _fbp. At the date of this Policy, there is no consent manager or website preference centre that delays these tools until a visitor makes a choice.

You can use browser controls to block or delete cookies and local storage, and provider controls where available. Blocking storage or scripts may affect website operation or measurement, but does not create a Searchmaxxed-managed preference record.

Browser storage may include lead identifiers, first-touch attribution, partial-lead flags and view, access or session state in localStorage, sessionStorage or cookies.

7. Communications and direct marketing

Submitting an enquiry or strategy request does not automatically subscribe you to general marketing. We may send confirmations, requested materials, booking information and other transactional or service messages needed to handle your enquiry or relationship.

If you submit a form presented as a subscription or marketing resource, we may use your email address to deliver that resource and send related Searchmaxxed marketing. Marketing messages will identify the sender and provide a way to unsubscribe. You can also opt out by emailing b@searchmaxxed.com. An opt-out from marketing does not necessarily stop transactional, security, legal or service communications.

8. Operational automation

Website and business-system automation may validate and deduplicate submissions, route enquiries, create or update CRM people, companies, deals, notes and tasks, and send confirmations or notifications.

No solely automated decision on this website produces legal or similarly significant effects about an individual. A form submission or automated workflow does not itself guarantee acceptance as a client, an offer, a result or a service engagement.

9. Overseas handling

Vercel, Google, Meta, Attio, Resend and Cal.com may process, store or allow access to personal information outside Australia. Based on current provider information, likely locations may include the United States and other locations used by those providers and their subprocessors. Those locations can change. You can contact us to request current information about likely overseas handling relevant to your information.

Where the Privacy Act 1988 (Cth) applies to us and we make an overseas disclosure, we take reasonable cross-border steps as required by law. Overseas privacy laws may differ from Australian law.

10. Security, retention and deletion

We use security measures appropriate to the information and the circumstances to reduce the risk of misuse, interference, loss and unauthorised access, modification or disclosure. No internet transmission, cloud service or storage system is completely secure.

Retention varies according to the purpose for which information was collected and applicable legal, accounting, operational and technical needs. Information may be retained while it is reasonably needed to administer a relationship, maintain records, resolve disputes, protect rights or meet those requirements.

You may ask us to consider deleting personal information. Deletion is subject to legal and operational requirements and may be declined or limited where information remains reasonably required or retention is permitted or required by law.

11. Access, correction and privacy requests

You may ask to access personal information we hold about you, ask us to correct information you believe is inaccurate, out of date, incomplete, irrelevant or misleading, or ask us to consider deletion.

Email b@searchmaxxed.com with enough detail for us to understand the request. We may ask for reasonable identity verification before disclosing, changing or deleting information. We consider requests and respond within a reasonable period. We may refuse or limit a request where permitted by law and will give reasons where required.

12. Privacy complaints

If you believe we have handled personal information inconsistently with this Policy or applicable privacy law, email b@searchmaxxed.com with your contact details, a description of the issue, relevant dates or documents and the outcome you seek.

We will consider the complaint and respond within a reasonable period. If you are not satisfied, you may be able to complain to the Office of the Australian Information Commissioner where that avenue is available and applicable.

13. Children and data incidents

The website is designed for business audiences. If we become aware that a child has provided personal information, we will consider the circumstances and applicable requirements in deciding how to handle it.

If a data incident affects personal information, assessment and notification will occur where and to the extent required by applicable law.
