These Website Terms of Use (Terms) apply to your access to and use of searchmaxxed.com and its public pages, content and website features (Website).
The Website is operated by MEMETIK PTY LTD (ABN 57 684 339 900), trading as Searchmaxxed (Searchmaxxed, we, us or our). By using the Website, you agree to these Terms. If you do not agree, do not use the Website.
1. Website use only
The Website provides general information about Searchmaxxed, our approach and services that may be available. These Terms govern Website access and information only. They do not set the scope, fees, deliverables, acceptance criteria, intellectual-property ownership, confidentiality obligations, liability arrangements, termination rights or other terms of paid services.
A paid engagement is governed by the applicable signed proposal, service agreement, statement of work or other written client agreement. If these Terms conflict with that written agreement, the written agreement prevails for the paid services to the extent of the conflict.
Sending an enquiry, booking a meeting, receiving information or accessing a proposal does not by itself require either party to enter an engagement.
2. General information, not professional advice
Website content is general information only. It is not legal, financial, tax, accounting, investment, medical or other tailored professional advice, and it does not take account of your circumstances.
You should obtain appropriate independent advice before relying on Website information for a commercial, technical, legal, financial, medical, regulatory or other material decision.
3. Search, AI and commercial outcomes
Search engines, AI systems, advertising platforms, social platforms, browsers and other third-party services operate independently. Their algorithms, policies, interfaces, data, availability, crawling, indexing, ranking, citation and recommendation methods can change without our control.
Except where Searchmaxxed makes a specific guarantee, refund or performance representation, general Website information does not by itself guarantee:
- rankings, positions, traffic, indexation, click-through rates, conversions, revenue, leads or timing;
- inclusion, citation, mention, recommendation or answer placement in Google, ChatGPT, Gemini, Perplexity, Claude, Copilot or another search or AI system;
- that content will be crawled, indexed, displayed, retained, approved or handled in a particular way by a third party;
- continuous availability of any platform, integration, data source or Website feature; or
- that your result will be identical to a case study, example, estimate, forecast or benchmark.
Results depend on factors including the offer, market, competition, website condition, public evidence, authority, budget, implementation, approvals, sales process, demand and third-party change.
Advertised guarantees and refunds
A specific guarantee or refund representation is governed by its own stated terms and any applicable written agreement. Nothing in these Website Terms limits a right arising from a specific representation or applicable law.
4. Permitted use and intellectual property
Unless stated otherwise, the Website and its content—including text, branding, graphics, layouts, designs, images, video, software, tools and downloadable materials—are owned by or licensed to Searchmaxxed and protected by intellectual-property laws.
You may access and use public Website content for ordinary personal or internal business reference. You may make reasonable, lawful and non-misleading attributed quotations. Legitimate search-engine and AI-search discovery, crawling and indexing are permitted where consistent with our robots.txt, applicable law and normal technical operation.
These permissions do not transfer intellectual-property rights or allow you to present our content as your own, imply endorsement, or create a substitute for the Website or our services.
5. Prohibited use
You must not use or attempt to use the Website to:
- break the law, act fraudulently or deceptively, or infringe another person’s rights;
- gain unauthorised access to systems, accounts, data, private content or security controls;
- introduce malicious code, disrupt service, overload infrastructure, evade reasonable access controls or test vulnerabilities without written authorisation;
- scrape or extract content at a volume, rate or manner that disrupts operation, circumvents controls or creates a competing or substitute publication, product or dataset;
- reproduce, republish, sell, license or commercially exploit substantial Website content without permission, except where lawfully permitted; or
- misrepresent your identity, affiliation with Searchmaxxed, or the source, meaning or endorsement of Website content.
We may take proportionate steps to restrict access where reasonably necessary to protect the Website, users, systems, private content or legal rights.
6. Information and materials you submit
You retain ownership of information, content, documents, feedback, files and other materials you submit. You confirm that you have the right to provide them and that doing so does not infringe another person’s rights or breach a duty of confidentiality.
You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, process, store and communicate submitted materials only to the extent reasonably necessary to respond to your enquiry, operate the Website, provide services you request under an applicable agreement, comply with law, and exercise or protect legal rights.
Do not send sensitive, confidential, regulated or highly personal material through an ordinary Website form unless we specifically request it and provide an appropriate method. Our handling of personal information is described in the Privacy Policy.
7. Third-party links and services
The Website may link to or integrate with third-party websites, booking tools, analytics services, social platforms, search engines, AI systems and other services. Third parties operate under their own terms and privacy policies.
A link, integration or reference does not automatically mean that Searchmaxxed endorses, controls, is affiliated with or is sponsored by the third party. We are not responsible for third-party content, availability, security, products, services or privacy practices.
8. Availability, accuracy and security
We aim to keep the Website useful and reasonably current, but information may be incomplete, outdated or contain errors. We may correct, update, suspend or withdraw Website content or features prospectively where reasonably required.
We do not promise uninterrupted availability, error-free operation, perfect security or that all Website information will suit your circumstances. You are responsible for reasonable device, browser, account, network, anti-malware and backup precautions.
9. Australian Consumer Law and liability
Nothing in these Terms excludes, restricts or modifies a right, remedy, guarantee, condition or warranty that cannot lawfully be excluded, restricted or modified, including applicable rights under the Australian Consumer Law.
Subject to those non-excludable rights, the Website is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we exclude implied representations, warranties, conditions and guarantees relating to the Website, and are not liable for indirect or consequential loss arising from Website access, unavailability or reliance on general Website information.
Where liability relating to the Website cannot lawfully be excluded but can lawfully be limited, our liability is limited only to the extent permitted by applicable law. Nothing in this section changes the liability terms of a separate signed client agreement or limits a right arising from a specific representation.
10. Changes to these Terms
We may update these Terms to reflect changes to the Website, our practices or applicable law. Changes apply prospectively from the updated date posted on this page; they do not retrospectively rewrite completed conduct or a separate signed agreement.
Where appropriate, we will provide reasonable notice of a material change. Your continued use of the Website after the effective date means the updated Terms apply to that later use, to the extent permitted by law.
11. Governing law and jurisdiction
These Terms are governed by the laws of Queensland and the Commonwealth of Australia. You and Searchmaxxed submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them.
12. General
If a provision of these Terms is invalid, illegal or unenforceable, it is severed only to the extent necessary and the remaining provisions continue.
A failure or delay in exercising a right does not waive that right. These Terms and the documents expressly incorporated into them form the entire agreement about use of the Website itself. They do not replace or modify a signed agreement for paid services.
